Unenforceable Regulated Consumer Credit Act Agreements
Aims and objectives
This course will make extensive use of working through examples, together with discussion, on common errors in agreements, insurance, multiple agreements, the relevant provisions of the Consumer Credit Act and Regulations, case law and other useful references in detail. Practical discussion, including exercises in drafting as appropriate:
- information and documents required
- identifying arguments for unenforceability
- tactics and approach – e.g. suggesting adjournments to discuss etc.
- letters to creditors/their representatives
- negotiating settlements
- submitting an initial defence
- applications for declarations under s142
- managing the case and the risks
- complex cases or those which cannot be settled – possible referrals, costs, timings etc.
- points to watch and possible pitfalls (Some detailed aspects may be subject to modification)
